Some debt collectors may act professionally while others don’t. If you have been contacted by an unprofessional collector, don’t despair. You have rights. Debt collectors must follow rules governed by the Fair Debt Collection Practices Act (FDCPA) when contacting you.

Consider these general rules when dealing with collectors:

• Debt collectors may not contact you at inconvenient times or places unless you agree to it. Tell collectors (orally or in writing) not to contact you at work.

• Every collector must send you a written notice, telling you how much money you owe within five days after they first contact you.

• Collectors may not harass, oppress or abuse you or any third parties they contact.

• Collectors may not lie, threaten or give false credit information when they are trying to collect a debt.

• Collectors may not engage in unfair practices.

• A collector may contact other people but only to find out your address, your home phone number and where you work.

• If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter.
